MOTOR VEHICLE ACCIDENT CLAIMS

If you’ve had an injury on the road and the accident was caused, at least in part, by someone else, we can help.

Motor Vehicle Accident claims can be made for injuries sustained in or associated with a motor vehicle, bus or truck, motorcycle or bicycle, or if struck by one of these as a pedestrian.

In Queensland, the “rego” purchased for each vehicle provides the driver with insurance in the event that that vehicle is involved in an accident and someone is hurt. This means that the insurer is liable to pay, rather than the person driving or riding in the vehicle. And, even when someone has forgotten or has failed to pay their vehicle registration, a claim can still be lodged by an injured person, though shorter timeframes apply for lodging such claims.

Who can make a motor vehicle accident claim?

Claims may be made by any of the following:

  • The driver of a motor vehicle (including motorcycles)

  • The passenger in or on a motor vehicle

  • Pedestrians struck by a motor vehicle

  • Cyclists who are involved in a vehicle collision

  • Motorcyclists who are involved in a vehicle collision

What types of things can I claim?

Typically, compensation claims include an allowance for:

  • Pain and suffering

  • Out-of-pocket expenses, such as medical, rehabilitation and medication expenses

  • Loss of income (both past, current and future)

  • Loss of superannuation upon loss of income

  • Future expenses, such as paid domestic assistance, medical costs and medication expenses

  • Interest upon losses suffered

  • (In some cases) care and assistance provided by family and friends.

What will it cost to lodge a claim?

Like most services, the costs typically depend upon the work required to get the job done. However, as a “No Win, No Fee”–guaranteed law firm, you won’t be charged for professional services or outlays if we don’t win your case. And, with no hidden costs and fees much lower than industry average, you’ll always receive the lion’s share of the proceeds when you work with us.
